EXPRESS LEARNING Centre’s Service

EXPRESS LEARNING CENTRE currently provides EXPRESS LEARNING CENTRE users with access to various on-line resources including online shopping, services and specialist content through its network of properties (the "Service"). Unless explicitly stated otherwise, any new features shall be subject to these terms and conditions.

Your registration obligations and supervising children
Certain aspects of the Service may require you to register and provide certain information about yourself. EXPRESS LEARNING CENTRE is concerned about the safety and privacy of all its users, particularly children. For this reason, If you are under 18 years of age, please do not pay for tuition online or sign up with us. We will be pleased to take an online application from your parent or guardian.
As the legal guardian, it is your responsibility to determine whether any of the Services and/or content are appropriate for your child or pupil.

Member account, password and security

The registration processes on the Website may involve you giving a password and account designation. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify EXPRESS LEARNING CENTRE of any unauthorised use of your password or account and any other breach of security, and (b) ensure that you exit from your account at the end of each session. EXPRESS LEARNING CENTRE, cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 5.

Your conduct

You acknowledge that all information, data (including Registration Data), text, software, music, sound, photographs, graphics, video, messages and other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not EXPRESS LEARNING CENTRE, are entirely responsible for all Content that you upload, post, email or otherwise transmit via the service or external weblinks from our website. EXPRESS LEARNING CENTRE does not control the content posted by users of the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You agree to indemnify and hold EXPRESS LEARNING CENTRE and its subsidiaries, affiliates of Express Learning Centre, officers, agents, co-branders and other partners, and employees, harmless from any claim or demand, including reasonable solicitors fees, made by any third party due to or arising out of content you submit, post to or transmit through the service, your use of the service, your connection to the Service, your violation of these terms and conditions, or your violation of any rights of another.

Dealing with advertisers and merchants

Your dealings with advertisers and merchants found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser or merchant. Governing Law

These terms and conditions, and all disclaimers and other material on our website, are governed by and written in accordance with English law. Any disputes shall be referred to the exclusive jurisdiction of the English courts, to which both parties submit.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM EXPRESS LEARNING CENTRE OR THROUGH OR FROM THE SHALL CREATE ANY WARRANTY OR OTHER OBLIGATION NOT EXPRESSLY STATED IN THE TERMS AND CONDITIONS.

General information

These terms and conditions (including the guides and rules referred to herein) constitute the entire agreement between you and EXPRESS LEARNING CENTRE and govern your use of the Service, superseding any prior agreements between you and EXPRESS LEARNING CENTRE. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software.

Payment Options & VAT

Once you've decided what tuitition fee you want to buy, you can choose from the following payment options through PayPal--and rest assured that your details are safe with us.
We accept Visa, Delta, Visa Electron, MasterCard, Eurocard, American Express, Maestro, Solo, cheques or postal orders (denominated in Pounds Sterling)
Note: we do not accept Eurocheques, cash in any currency or book tokens.

Refund Policy

The EXPRESS LEARNING CENTRE has approved the following policy regarding the payment of refunds of tuition fees. The purpose of this policy is to explain to students, sponsors and staff when refunds of tuition fees will be made by EXPRESS LEARNING CENTRE and how they will be calculated.

Such refunds only apply to the Tuition Fees paid in respect of term in which the Student leaves and refunds will be made within 31 days of the date when EXPRESS LEARNING CENTRE considers the Student to have left the us. For the avoidance of doubt, nothing in this policy shall require EXPRESS LEARNING CENTRE to refund the Fees (or any part thereof) unless such Fees (or any part thereof) have previously been paid.

Relevant or Related Legislation relating to payments made online with Express Learning Centre:
Distance Selling Regulations (DSR) 2000.
Consumer Protection (Distance Selling) Directive 97/7/EC.
(Other consumer legislation may apply according to circumstances)
Current Position on the Distance Selling Directive:
The UK Consumer Protection (Distance Selling) Regulations came into force on 31 October 2000 and implemented the Distance Selling Directive.

Key Facts:
• The Distance Selling Regulations apply to both goods and services, where the contract is made without any face-to-face contact between supplier and consumer.
• Certain goods and services are exempt from all or part of the Regulations.
The main provisions of the Regulations are that:
• Consumers must be given clear information about the goods or services before buying;
• Goods must be delivered within thirty days unless agreed otherwise;
• Consumers have a cooling off period in which they can withdraw from the contract for any reason. The cooling off period begins as soon as the order has been made.  In the case of goods, it ends seven working days after the day of receipt of the goods.  In the case of services, it ends seven working days after the day the tuition was paid for.  If the consumer agrees to the service beginning within the seven days, the right to cancel ends when the service starts; and
• Where consumers notify the supplier in writing or another durable medium that they wish to cancel the contract, they must be refunded within 30 days all money paid.

1) Full Refund of Tuition Fees Paid

You will receive a full refund of tuition fees paid if:
EXPRESS LEARNING CENTRE is unable to provide the course offered  
or
EXPRESS LEARNING CENTRE withdraws an offer of enrolment for any reason (except if you provided us with incomplete or incorrect information, in which case see paragraph 2 below) 

2) Partial Refunds of Tuition Fees Paid

Fees are not normally refundable once they have been paid. Applications in writing for partial refunds will be considered in exceptional circumstances (see below). Refunds requested more than one year after payment has been made will not be considered.
Assessment and/or registration fees are not refundable is in all cases non refundable.
If You withdraw part way through your course your fees for that term are non refundable. If you provide 14 days notice of withdrawal of your child from tuition with EXPRESS LEARNING CENTRE then no further payment from you will be sort by EXPRESS LEARNING CENTRE.

In the extremely unlikely event of  EXPRESS LEARNING CENTRE withdrawal of an offer or lesson then a full refund to the value of that offer or lesson would be refunded if monies have been paid in advance based on the offer or lesson.

If we cancel your registration on a course, because you provided us with incorrect and/or incomplete information in your application a partial refund may be due to you.

Partial refunds will be calculated as follows:
Refund = [Tuition fees paid] minus admin charge of £20 and also  [Tuition fees due]

Tuition fees due are calculated as follows:


1) Saturday. After school and specialized courses (inc SATS, GCSE and Grammar school course).
If the course you are taking is paid for per term in advance, you will be charged for each term that you have started.
a) All other courses. Fees due are calculated for each term from the start date of your course including that term in which you formally notify us of your withdrawal.

2) Exceptional Circumstances
No refund will be given to a student for the following circumstances:

a)   In the event of cancellation due to a family bereavement or any other change in your personal circumstances. Students are advised to take out insurance against such unforeseen circumstances.

If your child is sick please provide a doctors certificate and your fees paid in advance will not be affected. Instead they will be applied once your child is well against tuition.  Fees will be retained on the student account until studies are resumed or permanent withdrawal occurs. EXPRESS LEARNING CENTRE  will consider exceptional circumstances to those described above on a case by case basis on direct application to the Head of your learning centre. An admin fee of £20 will be taken in all cases from any fee due.

3) Withdrawing from Your Course

If you wish to withdraw from your course and you have exceptional circumstances you must first contact your Head of learning centre for approval. Please note that the Head of learning centre will not authorise any refund of tuition fees at this stage.

4)How to Request a Refund

You should write to the Student Finance Department attaching a copy of the letter to the Head of your learning centre notifying your withdrawal. Refund cheques will be made payable to the person or institution who paid the fees.

5) Monitoring the Policy

The Head of learning your EXPRESS LEARNING CENTRE will be responsible for monitoring your EXPRESS LEARNING CENTRE  policy to ensure consistency of application.
